Terms and conditions of battu brise

COMMUNICATION WITH THE STUDIO IS ESSENTIAL – all communication to come to Haleigh
van Rooyen via Whatsapp, Band or email.

registration

• All students are allowed 1 free trail class a year thereafter enrolment on a permanent basis

• A completed registration form is required when participating in classes. Failure to complete the registration form results in NO class attendance.

• There is an annual registration fee of R200.00 per family this is payable via eft or cash (if paying cash ensure money is placed in a sealed envelope, with the amount enclosed, handed to Haleigh van Rooyen)

• Re-registration fee per family this is payable at the start of each year via eft or cash (if paying cash ensure money is in a sealed envelope, with the amount enclosed, handed to Haleigh van Rooyen) or if your account was closed and you would like to re-activate your account. 

Cancellation

• If you wish to terminate your enrolment 1 calendar months’ notice is to be given in writing via email, No phone calls, SMS’s, WhatsApp’s, Band Messages or messages on our website will be accepted.

• Termination of enrolment at Battu Brise requires 1 calendar months’ notice and fees to be paid in FULL.

• Termination at the end of the year: notice to be given in November. If notice is not given in November you are required to complete your notice period in January of the next year.

Fees and Payment

• All invoices/accounts will be emailed before the end of the month – please ensure you have given a valid email address, both parents details and email addresses are required for children, preteen and teens.

• Fees are payable monthly and up front – payment is due no later than the 5th of the month

• Fees are payable via EFT, CARD or CASH

• If you are paying in cash, please ensure you have the Dancers full name and surname written on an enclosed envelope as well as the enclosed amount. Fees will not be accepted if it is not enclosed in an envelope.

• Late fees will result in an additional R250.00 penalty’s fee

Accounts that are 2 months late will be handed over for collection, the outstanding account holder will be liable for the expense incurred for this service.

• No refunds on classes missed or cancelled 24 hours prior to class.

• Students’ classes will be suspended until all outstanding fees are settled in full. We reserve the right to refuse to teach a student/ child should their account be in arrears. Battu Brisé reserves the right to refuse service, or ask any student to leave the school, at the owners’ discretion, with or without cause. Dance schools are regulated by Consumer Protection BC and must abide by the regulations set out in the Consumer Protection Act.

• Battu Brisé works on a 12 months calendar and a 4-term year.

• There are NO classes in the school holiday – unless make up lessons are needed.

•If my child cannot attend class/classes, am I still obligated to pay for the entire month? Yes, all classes must be paid for, even if not attended. No fees or part of fees will be refunded due to missed lessons

•If you are unable to pay your account and communication is given to Haleigh van Rooyen, your account can be put on hold or frozen, however the account balance owing is still due. A frozen account will not have any more fees added to it. A frozen account will be put on hold for a period of 3 months, after that if not communication on a return date is given the account will be closed and a re-registration fee is due to reopen the account. 

Additional Fees

• There are additional fees when it comes to examinations, concerts, festivals and competitions. There is a costume hire fee, as well as a hair and make-up if I (Haleigh van Rooyen) am asked to do hair and make-up. This is a restocking fee. This must be communicated well in advance, if assistance is needed for hair and make-up please ensure you contact Haleigh well in advance to ensure that a slot is booked for you

• Additional fees will be invoiced for extra classes for exams, competitions, festivals and year- end shows.

• Communication for these events will be given in advance by Haleigh van Rooyen. It is the responsibility of the parents or persons in charge of the account to notify Haleigh van Rooyen in writing via email by a given date if you do not or can not participate in the above-described events. Failure to inform Haleigh van Rooyen will result in the parents or persons in charge of the account being held liable for the fees invoiced for any concerts, shows, exams or festivals.

End of Year Concerts, Festivals and Competitions

• There are additional fees when it comes to concerts, festivals and competitions.

• Any and all Entry Fees for Exams or competitions need to be paid up front and in full

• There is a costume hire fee

• Hair and make-up fee is charged if I (Haleigh van Rooyen) am asked to do hair and make-up. This is a restocking fee. This needs to be communicated well in advance, if assistance is needed for hair and make-up, please ensure you contact Haleigh well in advance to ensure that a slot is booked for you.

• Costume hire fee needs to be paid in advance. No fee received no costume.

• If you do not wish to take part in competitions, festivals and concerts please notify Haleigh van Rooyen in writing (no WhatsApp’s, Telegram or SMS’s will be accepted) – please note a due date will be given in advance for communication to participate or not, if you have failed to communicate after the due date you will still be charged for costume hire.

• Festivals and Competitions are done every second year

• Year-end Concerts are done annually. An 85% – 100% attendance is required.

• Haleigh van Rooyen has full authority to withdraw any candidate who fails to attend 80% of the rehearsals when preparing for year-end concerts, competitions and festival or if the students account has not been settled.

• Competition, festival and Year- end candidates are eligible to be placed in the following category soloist, duets, trios and quartets. Examination groups are chosen by Haleigh van Rooyen and no changes will be made.

• Extra lesson may be added to the schedule during this time

• Additional fees will be invoiced for extra classes for exams, competitions, festivals and year- end shows

Examination

• There are additional fees when it comes to examinations.

• If you do not wish to take part in competitions, festivals and concerts please notify Haleigh van Rooyen in writing and by completing the studio examination form (no WhatsApp’s or SMS’s will be accepted)

• Year-end Concerts are done annually. An 85% – 100% attendance is required.

• Haleigh van Rooyen has full authority to withdraw any candidate who fails to attend 80% of the rehearsal when preparing for year-end concerts, competitions and festivals.

• There are 2 exam sessions a year (March, June /July and September to November)

• Exam candidates are soloist, duets, trios and quartets. Examination groups are chosen by Haleigh van Rooyen and no changes will be made.

• Examination are done through the Royal Academy of Dance and done internally.

• Additional fees will be invoiced for extra classes for exams, competitions, festivals and year- end shows.

Studio Terms and Timetable

• The studio is a 4 term, 12-month studio

• The timetable is sent out termly to the Whatsapp group and loaded onto our app “Band App”

• The timetable is subject to change throughout the year. Please ensure you are on our Whatsapp and band groups to receive this information. Any changes will be communicated in advance.

• If you are unable to attend a class it is your responsibility to communicate via Whatsapp or Band to Haleigh van Rooyen. Kindly communication 24 hours prior to class. Failure to do so will result in you still being charged for the class.

• If a class is cancelled due to me (Haleigh van Rooyen) being sick or other reasons a substitute will be brought in for the class, if not the class will be made up during the first week of school holidays. Communication will be done via Whatsapp and Band.

• If you are sick, you are welcome to join the online class. Kindly notify Haleigh van Rooyen 24 hours prior to the class to ensure the necessary arrangements can be made.

• It is the student’s responsibility to catch up any work they have missed.

• Unless communicated the studio is closed on weekends and on public holidays

• Please note messages will be answered during business hours. Message, emails or phone calls received outside of business hours will be answered on the following business day.

• Classes RSVP needs to be done via Band in the calendar or only, when necessary, done on Whatsapp or Telegram, communication on our website will not be accepted.

Communication and Social Media Platforms

• Please ensure that you have given all the correct details when filling out the enrolment form. If other parties’ details need to be given to Haleigh van Rooyen please ensure you send them as soon as possible.

• It is your responsibility to ensure that you are receiving all communications. If you are not, please message Haleigh van Rooyen.

• Communication is done via email, Whatsapp and Band.

• Pictures, videos and events will be posted on our studio app “Band” please ensure you are following our Band page and you are part on the necessary Bands.

• Due to the updated POPI act Band will be the main platform of communication as no personal information is shown or visible to others.

• If there is an urgent or important matter that needs to be brought to Haleigh van Rooyen’s attention please communicate this via Band, Whatsapp, Telegram and email.

• A telephone call will be followed by a “Band” message and email.

• Any queries or complaints are be directed to Haleigh van Rooyen immediately.

• If you would like to request a meeting please do so via email. An appointment will be booked for virtual or in person meeting. If you do not have an appointment, you cannot be helped, as there will be no time in-between classes for a quick chat.

• Confirmation of appointment will be done via email, Whatsapp and Band not done via our website.

• All dances, syllabus work and class work are subject to copy right laws.

• Pictures and videos of the class will occasionally be posted on “Band” no other platform will be used.

• For online classes Microsoft Teams is used and details will be sent via the Whatsapp group, Band and Telegram.

• Our social media platforms consist of Facebook, Instagram, Whatsapp, Tiktok, Band and Website.

• I (Haleigh van Rooyen) encourage parents to post and tag us on social media, however there may be times when it becomes negative. Any negative or harmful content posted about Haleigh van Rooyen or Battu Brisé will result in legal action for defamation and violation of the POPI act, this includes but not limited to any inappropriate, rude, negative, badmouthing comments or posts.

POPI Act

• Please ensure you have my written consent to send out my details. You may not forward my details to others without my knowledge and written consent.

• No pictures or videos may be shared on social media without Haleigh van Rooyen and everyone present in the picture or video’s written consent.

• Battu Brisé has your consent to use any pictures and videos (Head to toe) taken during the course of the year to be used for marketing purposes namely, promotional, publications, presentations, broadcast etc; done with full knowledge and consent, waiver all claims for compensation for use or for damage.

Uniform and Equipment

• Uniform requirements can be found on our Band App and on our website

• Any equipment needed can be found our Band App and, on our website,

• Any inappropriate uniform or uniform infringements will result in an email to the parents and the student will not be allowed to participate until the uniform is amended. Failure to do so on multiple occasion will result in the student being asked to leave the class or sit and observe the class.

• Any uniform purchase can be done through Haleigh van Rooyen via email.

• No loose hair or hair hanging down or in the face is allowed.

• No baggie and lose fitting clothes permitted.

• No torn clothing is permitted.

• No chewing gum or snack are permitted in the class.

• No juice or fizzy drinks are permitted in class.

• Please ensure you always have your ballet or exercise bag packed.

• Please ensure you are dressed appropriately at all times when entering, waiting or exiting the premises.

Covid 19 Protocols

• Parents and students understand and accept:

• all the risks associated with Covid 19.

• accept how Covid 19 is spread.

• accept the risk and cannot hold the studio or instructors responsible or liable for transmission of or an outbreak of the virus

• understand that wearing a mask over mouth and nose is compulsory, failure to do so, you will be asked to either correct it or leave the premises.

• Students and parents are to inform Haleigh van Rooyen immediately is a child, yourself or a family member has come in contact or is positive for Covid 19.

• If you are in isolation, please do not attend classes in person, join via the online platform. Communication in advance is necessary.

• Masks are to be worn at all times when entering the premises, during class and waiting for class to commence or end.

• Social distancing will be adhered to at all times

• Failure to abide, you will be asked to leave.

• Sanitizing before entering the class, during the class and at the end of the class are compulsory.

• Sanitizing of any props or equipment will be done immediately after use.

• Temperature and screen forms to be filled in before entering the class

Liability Release and Assumption of Risk

• Battu Brisé is a studio and not an aftercare facility. Battu Brise will not be held liable or responsible for children waiting to be fetched before and after class. If a child needs to wait, they are to wait in the studio room with me and parents are to collect the child from the studio room.

• Student hereby consent that they are in good health and consent to all the protocols and will either dance or exercise at their own risk, renouncing any and all claims against the studio that may arise from any source of personal injury, loss or damage.

• Accidents do happen however the student, dancers, parent, guardian release responsibility from Battu Brise from any causes of actions, claims, demands now and in future.

• Students, dancers, parents, guardians will not hold Battu Brise liable for any personal injury Battu Brisé and Haleigh van Rooyen will not be held liable for any damages or losses occurred these include but not limited to injuries, scratches, scratches, bruises, sprains, strains, broken bones, dislocations, concussions or death, damages or loss to your private property which may occur on the premise before, during or after classes.

• You hereby agree to obey all the protocols and take full responsibility for your behaviour in addition to any damages that may be caused to the facility utilized by Battu Brise.

Private lessons

• Private lessons are available upon request between student and Haleigh van Rooyen

• Termination of private lesson requires 1 full calendar months’ notice and fees to be paid in full

• Termination of private lessons may not be done withing the first 3 months of entering the private lessons.

• Termination is to be given in writing, SMS’s, phone calls, WhatsApp’s, Band messages, Telegram messages and message on our website will not be accepted.

• Registration and re-registration fees are still applicable

• Classes are available in person and online – for more information contact Haleigh

• Invoices are sent monthly via email or included in the general class invoices

• Communication is done via email and Whatsapp or Telegram and a private Band.

• Student is entitled to 1 group pilates class a week as part of the private class enrolment

• Cash payments to be in a seal envelope with full name and surname, date and amount enclosed.

• EFT payments must be made by the 5th of every month.

• Late payment is subject to a R200.00 collection fee and lesson suspension until the account is settled.

• Lesson is arranged for definite times and availability of Haleigh van Rooyen and the venue.

• Lessons are to be cancelled 24 hours prior to lesson, if not you will still be charged for the lesson.

• Unforeseen circumstance such as family and or personal emergencies are exempt from this rule at managements discretion.

BATTU BRISÉ RESOLVES THE RIGHT TO ADD OR CHANGE ANY TERMS AND CONDITIONS AT ANY TIME WITHOUT PRIOR NOTICE, HOWEVER ENDEVOUR TO INFORM ANY AND ALL STUDENTS OF AMMENDMENTS.
