TERMS AND CONDITIONS OF BATTU BRISÉ PTY LTD
COMMUNICATION WITH THE STUDIO IS ESSENTIAL – all communication to come to Haleigh
van Rooyen via Whatsapp, Band or email.
It is the student’s, parents or guardian’s responsibility to read and understand the Terms and Conditions of the Studio below when registering for classes. Any points that need clarification please direct them in writing to Haleigh van Rooyen via email.
These regulations are in place to ensure the safety of students, maintain a clean studio space and help the functioning of the studio in an effective manner.
REGISTRATION
• All students are allowed 1 free trail class a year thereafter enrolment on a permanent basis
• A completed registration form is required when participating in classes. Failure to complete the registration form results in NO class attendance.
• There is an annual registration fee per family this is payable via eft or cash (if paying cash ensure money is placed in a sealed envelope, with the amount enclosed, handed to Haleigh van Rooyen) on the day of registration.
• Re-registration fee per family this is payable at the start of each year via eft or cash (if paying cash ensure money is in a sealed envelope, with the amount enclosed, handed to Haleigh van Rooyen) or if your account was closed and you would like to re-activate your account.
• Paper contracts and digital contracts that are signed are equally as binding
CANCELLATION
• If you wish to terminate your enrolment 1 calendar months’ notice is to be given in writing via email, No phone calls, SMS’s, WhatsApp’s, Band Messages or messages on our website will be accepted.
• Termination of enrolment at Battu Brise requires 1 calendar months’ notice and fees for the notice month any outstanding fees to be paid in FULL.
• Termination at the end of the year: notice to be given in November. If notice is not given in November you are required to complete your notice period in January of the next year. The “opting-out” form needs to be completed to begin your termination of enrolment.
FEES, ADDITIONAL FEES & PAYMENTS
• All invoices/accounts will be emailed before the end of the month – please ensure you have given a valid email address, both parents details and email addresses are required for children, preteen and teens. If email address change or the inbox is full please provide an additional email address for the accounts.
• Fees are payable monthly and up front – payment is due no later than the 5th of the month – Class fees are paid strictly in advance
• Fees are payable via EFT, CARD or CASH
• If you are paying in cash, please ensure you have the Dancers full name and surname written on an enclosed envelope as well as the enclosed amount. Fees will not be accepted if it is not enclosed in an envelope.
• Late fees will result in an additional R250.00 penalty’s fee
Accounts that are 2 months late will be handed over for collection, the outstanding account holder will be liable for the expense incurred for this service. The student will be SUSPEND with immediate effect! If fees are still not paid after the suspension the student will have their enrollment with the studio cancelled and the account will be handed over as mentioned above.
• No refunds on classes missed or cancelled 24 hours prior to class.
• Students’ classes will be suspended until all outstanding fees are settled in full. We reserve the right to refuse to teach a student/ child should their account be in arrears. Battu Brisé reserves the right to refuse service, or ask any student to leave the school, at the owners’ discretion, with or without cause. Dance schools are regulated by Consumer Protection BC and must abide by the regulations set out in the Consumer Protection Act.
Suspended students may not participate in classes and if they arrive for class they will be asked to sit and watch the class or leave.
• Battu Brisé works on a 12 months calendar and a 4-term year. Fees are still payable in December and January as it is a 12 month period.
• There are NO classes in the school holiday – unless make up lessons are needed.
•If my child cannot attend class/classes, am I still obligated to pay for the entire month? Yes, all classes must be paid for, even if not attended. No fees or part of fees will be refunded due to missed lessons
•If you are unable to pay your account and communication is given to Haleigh van Rooyen, your account can be put on hold or frozen, however the account balance owing is still due. A frozen account will not have any more fees added to it. A frozen account will be put on hold for a period of 3 months, after that if not communication on a return date is given the account will be closed and a re-registration fee is due to reopen the account.

Additional Fees
• There are additional fees when it comes to examinations, concerts, festivals and competitions. There is a costume hire fee, as well as a hair and make-up if I (Haleigh van Rooyen) am asked to do hair and make-up. This is a restocking fee. This must be communicated well in advance, if assistance is needed for hair and make-up please ensure you contact Haleigh well in advance to ensure that a slot is booked for you via the google forms booking form.
• Additional fees will be invoiced for extra classes for exams, competitions, festivals and year- end shows.
• Communication for these events will be given in advance by Haleigh van Rooyen. It is the responsibility of the parents or persons in charge of the account to notify Haleigh van Rooyen in writing via email by a given date if you do not or can not participate in the above-described events. Failure to inform Haleigh van Rooyen will result in the parents or persons in charge of the account being held liable for the fees invoiced for any concerts, shows, exams or festivals.
• Props and costume hire fees will be charged per outfit per performance
END OF YEAR SHOWCASES, FESTIVALS, CONCERTS & FESTIVAL
• There are additional fees when it comes to concerts, festivals and competitions.
• All students need to complete the commitment form to confirm they will or will not be participating in concerts, showcases, competitions and festivals. By completing and digitally signing you are agreeing to the commitment and costing involved.
• Any and all Entry Fees for Exams or competitions need to be paid up front and in full – No entry fee no participation.
• There is a costume hire fee. The costume hire fee is paid in advance. No fees paid no costume.
All costumes rented from Battu Brisé must be returned in good condition after each performance. Failure to do so will result in “damage” fees being added to your account. Any missing accessories will be added to the account as well.
• Please note if students do not have the correct stockings a hired pair from the studio will be lent to the student along with ballet shoes –these items will be charged separately to costume hire. if these items are damaged in any way by the student, it is the students responsibility to replace or pay the full amount for the item to be replaced.
• Hair and make-up fee is charged if I (Haleigh van Rooyen) am asked to do hair and make-up. This is a restocking fee. This needs to be communicated well in advance, if assistance is needed for hair and make-up, please ensure you contact Haleigh well in advance to ensure that a slot is booked for you by completing our bookings form.
• If you do not wish to take part in competitions, festivals and concerts please notify Haleigh van Rooyen in writing (no WhatsApp’s, Telegram or SMS’s will be accepted) – please note a due date will be given in advance for communication to participate or not, if you have failed to communicate after the due date you will still be charged for costume hire.
• Festivals and Competitions are done every second year
• Year-end Concerts are done annually. An 85% – 100% attendance is required.
• Haleigh van Rooyen has full authority to withdraw any candidate who fails to attend 80% of the rehearsals when preparing for year-end concerts, competitions and festival or if the students account has not been settled.
• Competition, festival and Year- end candidates are eligible to be placed in the following category soloist, duets, trios and quartets. Examination groups are chosen by Haleigh van Rooyen and no changes will be made.
• Extra lesson may be added to the schedule during this time
• Additional fees will be invoiced for extra classes for exams, competitions, festivals and year- end shows
• Under no circumstances, may the choreography of the routine be changed by either a student, parent, guardian or another teacher. If this matter occurs, the student will be withdrawn from the competition and disqualified as the studio’s dancer in the competition or festival.
• If a student is absent repeatedly from class before the event, they will no longer be allowed to enter and will be withdrawn, however all costs incurred are still valid.
EXAMINATION
• There are additional fees when it comes to examinations. The fees are not determined by the studio they are sent to the studio from The Royal Academy of Dance South African Head Office.
• All students need to complete the commitment form to confirm they will or will not be participating in examinations or class awards. By completing and digitally signing you are agreeing to the commitment and costing
• If you do not wish to take part in the exams please notify Haleigh van Rooyen in writing and by completing the studio examination form (no WhatsApp’s or SMS’s will be accepted) and sending an email to the studio.
•Mock Exams will be done before the RAD examination, if your child or the student does not meet the necessary exam criteria during the Mock Exam – the student will be withdrawn with immediate effect and without a refund.
• If a student does not arrive for the RAD examination a doctors letter or medical certificate has to be provided in order to get a portion of the exam fees back from the Royal Academy – The studio does not refund the exam fees it is done through the Royal Academy South Africa Head Office. No medical certificate no refund on missed exams
• Haleigh van Rooyen has full authority to withdraw any candidate who fails to attend 80% of the rehearsal when preparing for examinations.
• There are 2 exam sessions a year (March, June /July and September to November)
• Exam candidates are soloist, duets, trios and quartets. Examination groups are chosen by Haleigh van Rooyen and no changes will be made.
• If a student does not do the examination or class award they do not receive a certificate and medal
• Additional fees will be invoiced for extra classes for exams
STUDIO TIMETABLE INFORMATION
• The studio is a 4 term, 12-month studio
• The timetable is sent out termly to the Whatsapp Channel, group and loaded onto our app “Band App”
• The timetable is subject to change throughout the year. Please ensure you are on our Whatsapp and band groups to receive this information. Any changes will be communicated in advance.
• If you are unable to attend a class it is your responsibility to communicate via Whatsapp or Band to Haleigh van Rooyen. Kindly communication 24 hours prior to class. Failure to do so will result in you still being charged for the class.
• If a class is cancelled due to me (Haleigh van Rooyen) being sick or other reasons a substitute will be brought in for the class, if not the class will be made up during the first week of school holidays. Communication will be done via Whatsapp and Band.
• If you are sick, you are welcome to join the online class. Kindly notify Haleigh van Rooyen 24 hours prior to the class to ensure the necessary arrangements can be made.
• It is the student’s responsibility to catch up any work they have missed.
• Unless communicated the studio is closed on weekends and on public holidays
• Please note messages will be answered during business hours. Message, emails or phone calls received outside of business hours will be answered on the following business day.
• Classes RSVP needs to be done via Band in the calendar or only, when necessary, done on Whatsapp.
COMMUNICATION & SOCIAL MEDIA PLATFORMS
• All communication to to come to Haleigh van Rooyen. Under no circumstance may messages be sent to the class teacher.
• Please ensure that you have given all the correct details when filling out the enrolment form. If other parties’ details need to be given to Haleigh van Rooyen please ensure you send them as soon as possible.
• It is your responsibility to ensure that you are receiving all communications. If you are not, please message Haleigh van Rooyen.
• Communication is done via email, Whatsapp and Band.
• It is the students, parents or guardians responsibility to join The Band App, to ensure they receive all studio communication via this application, all last-minute class details will be shared on Band and WhatsApp.
• Pictures, videos and events will be posted on our studio app “Band” please ensure you are following our Band page and you are part on the necessary Bands. Any content shared on Band App are purely for practice purposes and are not to be shared on social media platforms. This is infringing on the rights of the people in the video’s and the teacher’s choreography. You will be removed from the app and the relevant groups.
• Due to the updated POPI act Band will be the main platform of communication as no personal information is shown or visible to others.
• If there is an urgent or important matter that needs to be brought to Haleigh van Rooyen’s attention please communicate this via Band, Whatsapp and email.
• A telephone call will be followed by an email with the content discussed.
• Any queries or complaints are be directed to Haleigh van Rooyen immediately via email only.
• If you would like to request a meeting please do so via email. An appointment will be booked for virtual or in person meeting. If you do not have an appointment, you cannot be helped, as there will be no time in-between classes for a quick chat.
• Under no circumstances may lesson changes be discussed with the class teacher, it has to be discussed with Haleigh van Rooyen. If a lesson change is discussed with the teacher and not with Haleigh, Battu Brisé will not take responsibility for the lesson change. Students and teachers will be liable for additional costs of the venue if a lesson change is discussed between teacher and student. Please discuss with Haleigh – she will inform all involved of the changes.
• Changes to classes or catch up classes will be posted in the WhatsApp group and Band it is the parents or students responsibility to RSVP to confirm their attendance.
• All dances, syllabus work and class work are subject to copy right laws.
• Pictures and videos of the class will occasionally be posted on “Band” no other platform will be used.
• Our social media platforms consist of Facebook, Instagram, Whatsapp, Tiktok, Band and Website.
• I (Haleigh van Rooyen) encourage parents to post and tag us on social media, however there may be times when it becomes negative. Any negative or harmful content posted about Haleigh van Rooyen or Battu Brisé will result in legal action for defamation and violation of the POPI act, this includes but not limited to any inappropriate, rude, negative, badmouthing comments or posts.
• There is to be no teacher- student fraternization, this encompasses relationship that go beyond the normal scope of teacher – student interaction. This includes strong friendships, romantic relationships and other.
Lesson Policy
• NO SPECTATORS ARE ALLOWED IN AT ANY TIME OF THE CLASSES. The rule is there to ensure lessons are not disrupted and to allow students to focus on their class and the work being covered.
• NO PICTURES & VIDEOS may be taken while watching unless you are only filming your child.
• Family member are invited in only by Haleigh at the end of the Terms for our WATCHING DAYS. Haleigh will communicated this in advance via the Band App and WhatsApp Group. All family members attending are to please confirm their attendance for the watching days – no confirmation no entry.
• It is compulsory that you reserve yourself or child for EVERY class you attend. Even if you can not attend you need to respond to the calendar event in the Band calendar.
• No refunds are given for classes or catch up classes that are missed.
• NO classes will be held on Public Holidays or Sundays – applicable to ALL dance lessons.
• If you are more than 10 – 15 minutes late to arriving to class you will not be allowed to participate.
• If you are more than 15 minutes late without prior communication directly to Haleigh for every 5 minutes that you are late you will be charged a “baby sitting fee” of R50.00 per every 5 minutes. This fee will be added to your account.
• Please note that should you be late (having “baby sitting fees added until you arrive at the studio” and you arrive at the studio to collect a student and there is another class that is ongoing you will be asked to wait until that class is done as you are causing a disruption to the ongoing class and being disrespectful to those in the class and the teacher due to lack of communication and tardiness. The time you arrive will be noted so you are not billed for the time spent waiting for the next class to finish.
WE ARE NOT A DAYCARE OR AFTER CARE FACILIATY, ANY OUTSIDE PERSONS NOT REGISTRED WITH THE STUDIO THAT ARE COMING INTO THE PREMIS NEED TO COMPLETE OUR SPECTATORS FORM EACH TIME THEY COME WITH. IF WE DO NOT RECEIVE A COMPLETED SPECATOR FORM ACCESS WILL BE DENIED OR THEY WILL HAVE TO WAIT OUTSIDE UNTIL CLASS IS FINISHED AND THE STUDIO NOR THE TEACHERS OR THE STUDIO WILL BE LIABLE FOR THEM.
• Correct class attire is to be worn for each lesson.
Dance Attire Policy
At Battu Brisé Dance Studio, we uphold a strict policy regarding appropriate dance attire to maintain a professional and consistent image of our studio and to ensure the safety and comfort of our students. By adhering to this policy, students represent our studio with pride before, during, and after their classes.
- Required Attire: All students must wear the designated dance attire appropriate for their specific class. This includes leotards, tights, ballet shoes, or any other specified clothing as outlined by the instructor.
- Personal Grooming: Hair must be neatly secured and away from the face. Jewelry, except small stud earrings, is not permitted during classes.
- Inappropriate Attire: Any student dressed inappropriately, which includes but is not limited to, casual clothing, excessive jewelry, or incorrect footwear, will not be allowed to participate in class.
- Representing the Studio: Students are expected to present themselves in a manner that reflects positively on Battu Brisé Dance Studio. This includes maintaining the proper attire and grooming standards both inside and outside of the studio.
- Non-Compliance: Students who fail to adhere to the attire policy will be given a reminder. Continued non-compliance will result in the student being unable to participate in classes until the appropriate attire is worn.
We appreciate your cooperation and commitment to upholding the standards of Battu Brisé Dance Studio. These guidelines are designed to foster a disciplined and professional environment conducive to learning and growth in dance.
Loyalty
Loyalty to Battu Brisé expected from all students & parents. We are fully committed to growing with your dancer as they work towards their full potential, but like anything growth takes time and commitment, and we ask our parents to be as commit to our studio as we are to their children.
POPI Act
• Please ensure you have my written consent to send out my details. You may not forward my details to others without my knowledge and written consent.
• No pictures or videos may be shared on social media without Haleigh van Rooyen and everyone present in the picture or video’s written consent.
• Battu Brisé has your consent to use any pictures and videos (Head to toe) taken during the course of the year to be used for marketing purposes namely, promotional, publications, presentations, broadcast etc; done with full knowledge and consent, waiver all claims for compensation for use or for damage.
Uniform and Equipment
• Uniform requirements can be found on our Band App and on our website
• Any equipment needed can be found our Band App and, on our website,
• Any inappropriate uniform or uniform infringements will result in an email to the parents and the student will not be allowed to participate until the uniform is amended. Failure to do so on multiple occasion will result in the student being asked to leave the class or sit and observe the class.
• Any uniform purchase, hoodies, jackets and studio wear can be done through the dance shop o the website and via the dance shop email.
• No loose hair or hair hanging down or in the face is allowed.
• No baggie and lose fitting clothes permitted.
• No torn clothing is permitted.
• No chewing gum or snack are permitted in the class.
• No juice or fizzy drinks are permitted in class.
• Please ensure you always have your ballet or exercise bag packed.
• Please ensure you are dressed appropriately at all times when entering, waiting or exiting the premises.
Covid 19 Protocols
• Parents and students understand and accept:
• all the risks associated with Covid 19.
• accept how Covid 19 is spread.
• accept the risk and cannot hold the studio or instructors responsible or liable for transmission of or an outbreak of the virus
• understand that wearing a mask over mouth and nose is compulsory, failure to do so, you will be asked to either correct it or leave the premises.
• Students and parents are to inform Haleigh van Rooyen immediately is a child, yourself or a family member has come in contact or is positive for Covid 19.
• If you are in isolation, please do not attend classes in person, join via the online platform. Communication in advance is necessary.
• Masks are to be worn at all times when entering the premises, during class and waiting for class to commence or end.
• Social distancing will be adhered to at all times
• Failure to abide, you will be asked to leave.
• Sanitizing before entering the class, during the class and at the end of the class are compulsory.
• Sanitizing of any props or equipment will be done immediately after use.
• Temperature and screen forms to be filled in before entering the class
Liability Release and Assumption of Risk
• Battu Brisé is a studio and not an aftercare facility. Battu Brise will not be held liable or responsible for children waiting to be fetched before and after class. If a child needs to wait, they are to wait in the studio room with me and parents are to collect the child from the studio room.
• Student hereby consent that they are in good health and consent to all the protocols and will either dance or exercise at their own risk, renouncing any and all claims against the studio that may arise from any source of personal injury, loss or damage.
• Accidents do happen however the student, dancers, parent, guardian release responsibility from Battu Brise from any causes of actions, claims, demands now and in future.
• Students, dancers, parents, guardians will not hold Battu Brise liable for any personal injury Battu Brisé and Haleigh van Rooyen will not be held liable for any damages or losses occurred these include but not limited to injuries, scratches, scratches, bruises, sprains, strains, broken bones, dislocations, concussions or death, damages or loss to your private property which may occur on the premise before, during or after classes.
• You hereby agree to obey all the protocols and take full responsibility for your behavior in addition to any damages that may be caused to the facility utilized by Battu Brise.
• Battu Brisé will not be responsible for students outside of their class time. We encourage parents or guardians to walk their child in and to collect their child and walk them out of class when their class is finished. We are very sensitive to our students safety, however we are not responsible for students before and after class. We are not an aftercare center, please fetch your child as soon as the class is finished.
• If you are more than 15 minutes late to collect your child and you have not communicated with Haleigh van Rooyen you will be charged a “baby-sitting” fee of R50.00 for every 15 minutes you are late.
Private lessons
• Private lessons are available upon request between student and Haleigh van Rooyen
• Termination of private lesson requires 1 full calendar months’ notice and fees to be paid in full
• Termination of private lessons may not be done withing the first 3 months of entering the private lessons.
• Termination is to be given in writing, SMS’s, phone calls, WhatsApp’s, Band messages, Telegram messages and message on our website will not be accepted.
• Registration and re-registration fees are still applicable
• Classes are available in person and online – for more information contact Haleigh
• Invoices are sent monthly via email or included in the general class invoices
• Communication is done via email and Whatsapp or Telegram and a private Band.
• Student is entitled to 1 group pilates class a week as part of the private class enrolment
• Cash payments to be in a seal envelope with full name and surname, date and amount enclosed.
• EFT payments must be made by the 5th of every month.
• Late payment is subject to a R200.00 collection fee and lesson suspension until the account is settled.
• Lesson is arranged for definite times and availability of Haleigh van Rooyen and the venue.
• Lessons are to be cancelled 24 hours prior to lesson, if not you will still be charged for the lesson.
• Unforeseen circumstance such as family and or personal emergencies are exempt from this rule at managements discretion.
DEFAMATION
No student, parent or guardian of Battu Brisé shall make public or publish any statement or comments that will likely damage the reputation of the studio or the teachers of the studio. If any of the above happens there will be server consequences and possible legal action taken of the parties involved.
General Rules
• No Balls or play items brough from home are allowed in dance class, no roughhousing or doing tricks without a teacher being present.
•Students and families who use the play area, use it at their own risk, the venue nor the studio will be responsible for injuries or other.
• Keep hands and feet to yourself, respect the rights of other and the property we use for our classes.
• Battu Brisé has a strict NO BULLYING policy and any student caught bullying others (verbal or physical or other) will be suspended with immediate effect, pending a formal meeting to discuss grounds for expulsion.
• No parents or family member are permitted to sit in during class unless it is a watching day that is has been arranged by the studio. NO EXCEPTIONS!!!!
• We reserve the right to inform a students that he/she should seek instruction elsewhere if his/her behavior – or that of the parent/ family member or caregivers – is disruptive and disrespectful.

BATTU BRISÉ RESOLVES THE RIGHT TO ADD OR CHANGE ANY TERMS AND CONDITIONS AT ANY TIME WITHOUT PRIOR NOTICE, HOWEVER ENDEVOUR TO INFORM ANY AND ALL STUDENTS OF AMMENDMENTS.
